The comment period for a proposed rule to update the regulations on the procedures by which Bureau of Indian Affairs Secretarial elections are handled has been extended to January 16 according to Assistant Secretary – Indian Affairs Kevin K. Washburn.
The Secretarial election process is a federal election conducted by the Secretary of Interior under a federal statute or tribal governing document in accordance with 25 CFR Part 81.
The rule in question looks to update two areas of the BIA regulations: 25 CFR Part 81 – this governs how the BIA conducts such elections for federally recognized tribes; 25 CFR Part 82 – how tribal members can petition for a Secretarial election. The update through the proposed rule would combine these two provisions into one Code of Federal Regulations part at 25 CFR Part 81 – while making further updates to reflect changes in statutory law.
Three consultation sessions were held throughout the year with tribal leaders, but is still interested in any additional comments.
